Parliamentary majority, hastily assembled in late February, did not always manage to poll 226 votes - the minimum required to adopt the laws. At the same time pretty thin fraction of the Party of Regions (in April they lost 18 "bayonets", now down to 103 members) usually ignores majority voting. Communists had completely gone in the deaf defense – not a single vote of the "reds" was polled for lawmaking in April.
Parliament did not have time to adjust to the new working format: as soon as the government and the opposition had been reshuffled after Yanukovych’s escape in February, Russian military aggression had begun in Crimea, following with Moscow-sponsored separatist protests in the Donbas. As a result, the agenda of parliamentarians focused mostly on military situation in the east. In between, the MPs had voted for some reform laws. At the same time they resisted provisions that would significantly change the transparency of ownership rights system.
The following laws are worth mentioning among the achievements of parliamentarians for the second month of spring (April 2014):
Party of Regions and the Communist Party: ended up with nothing
Back in March the Party of Regions (PR) reluctantly supported the new majority, devoting a dozen or two votes for the important draft laws to start economic reforms. Yet in April the situation in the county had changed, and the former ruling party’s vane was pointing to a different direction. For everyone to see, PR MPs were looking insulted by the country's leadership failure to handle the talks with the separatist militants in the Donbas. Moreover, some public figures of this political party (specifically Olexandr Yefremov and Oleg Tsariov) had blatantly supported terrorist organizations of Donetsk and Luhansk Republics. All these in total negated PR’s part in lawmaking.
Inner turbulence of the PR faction caused by the conflict over the nomination of the odious presidential candidate Mykhailo Dobkin and refusal to support the ambitions of Serhiy Tihipko, Oleg Tsariov and Renat Kuzmin, caused the talks about the further destiny of PR as a political actor.
There is little doubt that the former deputy prime minister, who wimped out his "Sylna Ukraina" at the beginning of Yanukovych’s term, would consider revival of his party and attract parliamentarians and members of the local PR branches. The former mayor of Kharkiv is unlikely to become the new face of the party, which announced the transition to the collegiate governance. The "old guard" leaders of the Party of Regions had publicly discredited themselves, especially during Euromaidan events, and thus would not be able to restore the former party unity. Finally, PR had lost its electoral stronghold in the Donetsk region by taking reluctant approach to protection of the rights of citizens, "doublethink" and simultaneous supporting the "militias” demanding the Donbas separation from Ukraine, backed up with the desire to maintain their position in the political elite.
Early parliamentary elections promised by prospective president Poroshenko sound unfavorable for the PR. The party appeared on the verge of electoral barrier: their presidential candidate was gaining nearly 3%. Loss of administrative influence coupled with the loss of Crimean and Donbas voters will either lead to party’s radical internal changes, or throw it to the side of political life. The same had happened before to the Progressive Socialist Party of Natalya Vitrenko and Socialist Party of Olexandr Moroz. The main party’s "shareholder" Rinat Akhmetov is in no hurry to bind his future with the PR, despite the offer of Hanna Herman to elect the billionaire as party leader.
In April PR MPs granted the maximum support - 41 voices - for the amendments to the Customs Code (4646), in which the Cabinet has offered to make a few changes to increase state revenues.
Also, PR and the Communists had tried to ensure amnesty for members of separatist protests in the east of Ukraine (drafts 4667 and 4667-4), similarly to opposition move during Euromaidan. In addition, a significant portion of the PR’s April draft laws was devoted to amendments to tax rules and regulation of markets (see the table below).
It should be noted that after losing power PR representatives also imbued with the introduction of the state program of import substitution (4718), which could be caused either by concerns over excessive dependence of Ukrainian economy from Russia, or their own prospects of keeping business. Following a series of draft laws introduced by PR MPs in the zenith of the Yanukovych regime providing for the actual introduction of censorship in the global net according to the Russian model, the PR representative paradoxically suggested to amend the Civil Code with new private right – the right of everyone to access the Internet (4715).
PR pre-election promises of 2012, which echoed theses of Yanukovych, are unlikely to be referred to further. Party of Regions faces a question of political survival in anticipation of possible parliamentary elections. Party program itself requires the major revision. Restoration of an image and electoral support at least in some oblasts requires substantial effort.
The Communists have initiated only three draft laws. Generally they seem to have taken silent protest position. After Parliament speaker Oleksandr Turchynov accused CPU leader Petro Symonenko of a lie the trial preparations began on possible ban of the "red-banner" political party. An overt support for pro-Russian fighters in the Donbas and rocking separatist sentiments can do dirt for this retro-time political actor. Petro Symonenko withdrew from election after the deadline and got about one percent of the popular vote. Projecting this figure to the possible parliamentary snap elections suggests the Communists would not make it to the next Verkhovna Rada. Unless the eastern electorate would again believe Symonenko’s speeches against the oligarchs and fascists.
"Batkivschyna”/ UDAR / Svoboda: working double tides
After the Ukrainian winter events the opposition parties had no choice of alternative behavior in Parliament: taking power into own hands, they tried not to lose credibility, which was already shaken. Many promises given to the people on Maidan are still awaiting fulfillment. First of all we are talking about fighting corruption (and providing relevant agency in charge) and lustration. However, the relevant laws were not included in the April agenda of the Parliament, not least because of changing priorities. The parliamentary majority had to deal with questions of national defense and heated discussion with pro-Russian forces in the Parliament: the Party of Regions and the Communists.
At the same time, MPs needed to support the Cabinet of Ministers with relevant legislative activity, especially in the economic and budget spheres. The areas of consideration of the "three pillars" of today’s coalition were quite similar in April. These covered taxation and amendments to the Tax Code, regulation of markets (specifically, fuel and energy and pharmaceutical), and protection of the rights of citizens mobilized into the army or those who entered the National Guard and reside in the territories of the antiterrorist operation.
It is worth to mention the failure to combine the powers of Kyiv mayor and chairman of the Kyiv City State Administration, previously announced by UDAR. MPs did not manage to poll enough votes to return the old rules to the capital. Svoboda also failed to introduce obligatory information about person’s nationality in Ukrainian passport.
April agenda also omitted another major project aimed at reforming the system of documents in Ukraine. Instead of obsolete "internal passport" the draft law 4751 introduced plastic IDs and "armed" international passports with chips with biometric data. Such move would be another step towards the simplification of visa regime with the EU.
The stability of the parliamentary majority, however, remains questionable, given the projected results of the presidential elections and possible snap elections of Rada. Estimated defeat of Yulia Tymoshenko threatens with collapse of the “Batkivschyna” faction, its apparent or hidden opposition or reforming.
The situation in Crimea and aggravation of the separatism in the east also demonstrated some sluggishness of the current authorities. Moreover, shifting the focus of citizen attention towards terrorism in the Donbas allowed parliamentarians to suspend the issues of lustration, fight against corruption and the State Property Register.
In any case, the history of present convocation of Verkhovna Rada suggests that its actual legitimacy will terminate with the inauguration of a new president. Way too many MPs of all factions had discredited themselves. In order to fulfill their promises of clean government system and build "New Ukraine" MPs should obtain the confidence of the voters - not in the legal, but in political terms. Obviously, the possible snap elections will significantly change the composition of the Verkhovna Rada, adding new actors and relieving from the most reactionary elements.
The question of drafting the new Constitution remains blurred. Parliament regularly reports on the activities of the relevant groups, but the final text of the document was never made public. The Constitution draft, substantially cutting presidential powers in favor of Parliament was published in the media and sent to the Venice Commission. However, MPs refuse to have anything to do with the official fate of this document. It is unclear what happened to the suggestions of the Constitutional Assembly established by Yanukovych. It is also in question why the process of preparing the reform of the Basic Law is happening behind the scenes, without the involvement of the citizens.
In addition, the parliamentary majority has to develop the Electoral Code or a set of similar documents. Before, the majority led by the Party of Regions refused to adopt these. The change of parliamentary election mechanism remains one of the most pressing issues, including return to the proportional system and the introduction of open lists. The willingness of parliamentarians to open the opportunities for real and transparent political competition would confirm their ability to clean and cure the political class. Otherwise Parliament, an actor which can obtain considerable powers after the Constitutional reform, will remain backstage area for implementation of shady interests rather than debates and development of the effective policies for the country.
